  • Quels sont les objectifs des bilans de comp\u00e9tences ?<\/strong>
    Les actions permettant de r\u00e9aliser un bilan de comp\u00e9tences ont pour objet de permettre \u00e0 des travailleurs d’analyser leurs comp\u00e9tences professionnelles et personnelles ainsi que leurs aptitudes et leurs motivations afin de d\u00e9finir un projet professionnel et, le cas \u00e9ch\u00e9ant, un
    projet de formation (Art. L. 6313-4 CT).<\/li>\n
  • Quel est le cadre l\u00e9gal et r\u00e9glementaire li\u00e9 aux bilans de comp\u00e9tences ? Le bilan de comp\u00e9tences (\u2026) comprend, sous la conduite du prestataire effectuant ce bilan, les 3 phases suivantes :<\/strong><\/li>\n<\/ul>\n

    1\u00b0 Une phase pr\u00e9liminaire qui a pour objet :<\/p>\n

      \n
    • d’analyser la demande et le besoin du b\u00e9n\u00e9ficiaire,<\/li>\n
    • de d\u00e9terminer le format le plus adapt\u00e9 \u00e0 la situation et au besoin,<\/li>\n
    • de d\u00e9finir conjointement les modalit\u00e9s de d\u00e9roulement du bilan,<\/li>\n<\/ul>\n

      2\u00b0 Une phase d’investigation permettant au b\u00e9n\u00e9ficiaire soit de construire son projet
      professionnel et d’en v\u00e9rifier la pertinence, soit d’\u00e9laborer une ou plusieurs alternatives,<\/p>\n

      3\u00b0 Une phase de conclusions qui, par la voie d’entretiens personnalis\u00e9s, permet au
      b\u00e9n\u00e9ficiaire\u00a0:<\/p>\n

      • de s’approprier les r\u00e9sultats d\u00e9taill\u00e9s de la phase d’investigation,<\/li>\n
      • de recenser les conditions et moyens favorisant la r\u00e9alisation du ou des projets professionnels,<\/li>\n
      • de pr\u00e9voir les principales modalit\u00e9s et \u00e9tapes du ou des projets professionnels, dont la possibilit\u00e9 de b\u00e9n\u00e9ficier d’un entretien de suivi avec le prestataire de bilan de

        Les employeurs ne peuvent pas r\u00e9aliser eux-m\u00eames des bilans de comp\u00e9tences pour leurs salari\u00e9s (Art. R. 6313-5 CT)
        Ce bilan ne peut \u00eatre r\u00e9alis\u00e9 qu’avec le consentement du travailleur. Le refus d’un salari\u00e9 d’y consentir ne constitue ni une faute ni un motif de licenciement (Art. L. 6313-4 CT). L\u2019organisme prestataire de bilans de comp\u00e9tences qui exerce par ailleurs d’autres activit\u00e9s dispose en son sein d’une organisation identifi\u00e9e, sp\u00e9cifiquement destin\u00e9e \u00e0 la r\u00e9alisation de
        bilans de comp\u00e9tences (Art. R. 6313-6 CT).
        L\u2019organisme prestataire de bilans de comp\u00e9tences proc\u00e8de \u00e0 la destruction des documents \u00e9labor\u00e9s pour la r\u00e9alisation du bilan de comp\u00e9tences, d\u00e8s le terme de l’action.<\/p>\n

        Toutefois, les dispositions du premier alin\u00e9a ne s’appliquent pas pendant 1 an :<\/p>\n

          \n
        • au document de synth\u00e8se dans le cas mentionn\u00e9 au 3\u00e8me alin\u00e9a de l’article L. 6313-4<\/li>\n
        • aux documents faisant l’objet d’un accord \u00e9crit du b\u00e9n\u00e9ficiaire fond\u00e9 sur la n\u00e9cessit\u00e9 d’un suivi de sa situation (Art. R. 6313-7 CT)<\/li>\n<\/ul>\n

          Les informations demand\u00e9es au b\u00e9n\u00e9ficiaire du bilan doivent pr\u00e9senter un lien direct et n\u00e9cessaire avec son objet. Le b\u00e9n\u00e9ficiaire est tenu d’y r\u00e9pondre de bonne foi. Il est seul destinataire des r\u00e9sultats d\u00e9taill\u00e9s et d’un document de synth\u00e8se qui ne peuvent \u00eatre communiqu\u00e9s \u00e0 un tiers qu’avec son accord. Les personnes charg\u00e9es de r\u00e9aliser et de d\u00e9tenir les bilans sont soumises aux dispositions des articles 226-13 et 226-14 du code p\u00e9nal en ce qui concerne les informations qu’elles d\u00e9tiennent \u00e0 ce titre (Art. L. 6313-4
          CT).
          Lorsque le bilan de comp\u00e9tences est r\u00e9alis\u00e9 au titre du plan de d\u00e9veloppement des
          comp\u00e9tences mentionn\u00e9 au 1\u00b0 de l’article L. 6312-1 ou dans le cadre d’un cong\u00e9 de
          reclassement dans les conditions pr\u00e9vues \u00e0 l’article L. 1233-71, il fait l’objet d’une
          convention \u00e9crite conclue entre l’employeur, le salari\u00e9 et l’organisme prestataire du bilan de comp\u00e9tences.<\/p>\n
